Robert Rhodes Wins Appeal of Premises Liability Case for Property Owner

FLB Law Partner Robert Rhodes won an appeal of a premises liability case on behalf of a property owner, upholding the lower court’s decision.

The case involved a woman who slipped and fell on a clear, slippery substance near the hotel lobby and broke her left knee, which required at least one surgery and which the plaintiff claimed caused her pain. In the underlying case, the plaintiff asserted that the slippery substance had been on the floor for at least 20 minutes, creating a hazardous situation of which the hotel should have been aware and removed. However, the defense was able to demonstrate with surveillance footage that the timeframe was unclear and that about 100 people had walked on that section of the floor that the plaintiff claimed was slippery without incident.
