Eric Bernheim to Present at the International Council of Shopping Center (ICSC) Conference

FLB Law Partner Eric Bernheim, head of the firm’s Real Estate & Land Use Practice, will be presenting at the ICSC+U.S. LAW national conference scheduled for October 25-27, 2023, in Phoenix, AZ. The session, “What Lenders Really Want to See in Leases—Taking the Guesswork Out of Making Your Lender Happy,” will focus on lender “must haves” in order to finance a leasehold interest and how you can get your landlord to (grudgingly) agree to them.

The fact is leasehold lending, which involves providing a loan secured by a lien on a tenant's leasehold interest in a property, can be a complex form of real estate lending. The lender's collateral is less tangible than in a traditional real estate loan, increasing the risks involved. Due to these risks, some lenders decline to make leasehold loans altogether. Lenders who do engage in leasehold lending conduct a comprehensive assessment of the proposed lease, expecting it to include several lender protections aimed at reducing risk. This session will discuss the essential provisions that lenders require to consider a lease "financeable."
